Trulieve Rewards Terms & Conditions

These Terms and Conditions apply to your access to, and participation in, the Trulieve Rewards Program, which is operated by Trulieve or its respective subsidiaries, licensees and affiliated companies (collectively, "Trulieve"). These Terms and Conditions do not alter in any way the terms or conditions of any other agreement you may have with Trulieve for other products or services, such as the Trulieve website.

CHANGES TO TERMS

Trulieve reserves the right to change or modify these Terms and Conditions or any policy, FAQ, offer, promotion, benefit or guideline pertaining to Trulieve Rewards Program, in whole or in part, at any time and in its sole discretion. Any changes or modifications will be effective immediately and may be posted to www.trulieve.com, so please check back from time to time. Trulieve will make reasonable efforts to provide notice of material changes, but you waive any right you may have to receive specific notice of such changes or modifications. Such changes will apply prospectively only to points earned after the effective date, and your continued access to or participation in Trulieve Rewards Program following any such changes or modifications confirms your acceptance. If you do not agree to these Terms and Conditions, you must stop accessing and participating in Trulieve Rewards Program.

PERSONAL USE

The Trulieve Rewards Program is intended for personal use only. Commercial use is prohibited. The Trulieve Rewards Program is not targeted towards, nor intended for use by, anyone under the age of 21 or 18 with applicable state medical cannabis card.

Our Privacy Policy is incorporated into these Terms and Conditions and governs Your participation in Trulieve Rewards Program. Please read the Privacy Policy fully to understand how Trulieve collects, uses and discloses information about customers, how to update or change your personal information, and how we communicate with you.

1.   Stackable Rewards: Rewards earned through the Trulieve Rewards Program may be stacked with sales and ongoing discounts. Exclusions and restrictions on this may vary by state and we have the right to modify this at any time. Rewards cannot be stacked with the New Customer Discounts. 

2.   Modification Rights: Trulieve reserves the right to modify or impose additional restrictions on the usage of points and discounts at any time. This may include changes in the points system, alteration of discount percentages, or adjustments in eligibility criteria for certain offers.

3.   Rights to Modify Program: Trulieve reserves the right to change or terminate the Trulieve Rewards Program, adjust point values, or alter benefits without prior notice to participants. Participants will be informed of any significant changes through the contact information provided at the time of enrollment.

4.   Minimum Purchase: In accordance with state law, minimum purchase may apply when redeeming points.

Returns and Refunds

5. Returns and Refunds: If you return a product for which you had earned rewards points, those points will be subtracted from your account to reflect the return. Rewards redemptions are non-refundable. Not applicable on returns for recalled and/or defective products.

6. Bonus Points and Returns: Should you return a product that earned you bonus points due to a special promotion, such bonus points will be deducted from your account upon the return of the product. Not applicable on returns for recalled and/or defective products.

7.   Promotional Returns: For products purchased during a 'Buy 2, Get 1 Free' promotion (state restrictions apply), if any product is returned, the return will be processed in accordance with the specific terms of the promotional offer.

8. Expiration of Points Upon Return: Points re-credited to your account upon return of a product will be considered as newly earned points and will thus be subject to the standard points expiration policy which expires points at 90 days. 

9. Expiration of Points: All points earned will expire 90-days after they are earned, unless otherwise specified. Member can track the expiration date of all points earned via the “Activity” tab in their profile at rewards.trulieve.com. FL member can track expiration dates in the Trulieve mobile app.

10. Equal Value Exchanges: When You exchange a product for another of the same value, your points balance will remain unaffected.

11. Exchanging for a Higher-Value Item: If you exchange for a product of higher value, you will receive additional points equivalent to the price difference.

12. Exchanging for a Lower-Value Item: Conversely, if you exchange for a product of lower value, the points difference will be deducted from your account. Not applicable on returns for recalled and/or defective products.

13. Notwithstanding anything to the contrary in these Terms and Conditions, no points, rewards, tier status, or benefits will be forfeited, reduced, expired, or penalized as a result of returns, exchanges, or refunds due to recalled, defective, damaged, or non-conforming products.

Special Promotions and Product Categories

14. Maintaining Bonus Points on Exchanges: If you exchange an item associated with bonus points for a product of similar or higher value, your bonus points will be preserved.

15. Adjusting Points for Product Category Exchanges: Points may be adjusted if your exchange products across different categories that have differing points values.

Enrollment and Account Management

16. Account Creation: To join the Trulieve Rewards Program, you may use the QR codes provided in-store or complete the user-friendly online enrollment form. The form requires personal details and features progress indicators for ease of use.

17. Account Verification: After enrollment, you will receive an email to confirm you have subscribed to the Trulieve Rewards Program.

18. Marketing: You will have the option to consent to receive marketing promotions at the time of sign up.

19. Personal Information: We will collect necessary personal information during the enrollment process, including your name, date of birth, email address, and phone number. We use personal information to conduct our business and to provide you with high quality products and services. Please see the Privacy Policy for more information.

20. Consent: By enrolling, you consent to our marketing communications regarding the Trulieve Reward Program and acknowledge the terms and conditions of the Trulieve Rewards Program, which includes our data collection and usage practices in compliance with applicable data protection regulations.

21. Optional Geographic Information: You may provide your home state to customize your experience with location-based services.

22. Account Deactivation or Deletion: You retain the right to deactivate or permanently delete your account, in accordance with data protection regulations. If You wish to permanently delete your account, you may email rewards@trulieve.com.

Customer Service and Support

23. Clear Communication: Our policies on returns and point deductions are designed to be transparent and accessible. Our customer service team is trained to assist you with any queries related to these policies. You can contact our support team at rewards@trulieve.com.

24. Customer Support: Customer service representatives are trained to address Trulieve Rewards Program related inquiries and have the authority to make necessary adjustments to points based on transactional errors.

Miscellaneous Terms

25. Data Transfer: The points and rewards visible in your account will reflect your latest transactions, typically updated in real-time, however some actions may take up to 48 hours to reflect in your account. These actions may include but are not limited to; Additions or deductions for returns or exchanges, new point accruals, point accruals for completing engagement actions, rewards based off behaviors. 

State-Specific Program Variations

26. The Trulieve Rewards Program is tailored to meet the diverse requirements of each state in which we operate, in full compliance with state-specific regulations. As such, the Trulieve Reward Program’s features, benefits, and point systems may vary from one state to another. By participating in the Trulieve Rewards Program, you agree to adhere to the terms and conditions that are applicable within your state of residence. These state-specific terms are subject to change. Your continued participation in the Trulieve Rewards Program constitutes your acceptance of these terms and any changes or modifications made to comply with local regulations.

Reward Redemption Tiers

As a valued participant of the Trulieve Rewards Program you are entitled to redeem your accumulated points for rewards as follows.

All Markets Except FL:

  • Redeem 100 points for a $5 reward.
  • Redeem 250 points for a $15 reward.
  • Redeem 500 points for a $35 reward.
  • Redeem 1,000 points for a $75 reward.
  • Redeem 2,000 points for a $160 reward.

Florida Only:

With the introduction of a four-tier Trulieve Rewards Program, FL members are limited to a maximum redemption value based on their current tier status regardless of their total point balance. Redemption Values by Tier are as follows:

  • Tru-Member:
    • Redeem 100 points for a $4 reward.
    • Redeem 250 points for a $10 reward.
  • Tru-Insider:
    • Redeem 100 points for a $4 reward.
    • Redeem 250 points for a $12.50 reward.
    • Redeem 500 points for a $30 reward.
  • Tru-Elite:
    • Redeem 100 points for a $5 reward.
    • Redeem 250 points for a $15 reward.
    • Redeem 500 points for a $30 reward.
    • Redeem 1,000 points for a $75 reward.
  • Tru-Icon:
    • Redeem 100 points for a $5 reward.
    • Redeem 250 points for a $15 reward.
    • Redeem 500 points for a $35 reward.
    • Redeem 1,000 points for a $75 reward.
    • Redeem 2,000 points for a $160 reward.

Rewards must be redeemed in their entirety. Splitting the value of a single reward or combining multiple rewards towards a single purchase is not permitted. Limit of one reward redemption per day. Multiple redemptions across multiple transactions in the same day is not permitted. Each reward redemption tier is designed to provide incremental value, rewarding you for your continued loyalty.

Earning Points Beyond Purchases

The Trulieve Rewards Program offers multiple ways to earn points outside of purchasing events, enhancing your ability to accumulate rewards. These bonuses may vary by state.

  • Create a Loyalty account: Earn 20 points. (not available in FL)
  • Birthday Bonus: Receive 100 points on your birthday, credited to your account on the day of your birthday as set at the time of sign-up
  • Refer-a-Friend: refer a friend to Trulieve Rewards Program and both of you earn 100 points after they complete their first purchase as a Trulieve Rewards Program member. (Unavailable in FL)

In addition, you can earn bonus points for certain spending thresholds (*excludes taxes and/or fees):

  • Spend over $500 in a single purchase: Earn 500 points. (Unavailable in FL & PA)
  • Shop 4 times within a calendar month: Earn 100 points. (Unavailable in FL & PA)
  • FL Only: Shop 5 times within a calendar month – Tru-Icon and Tru-Elite members earn 100 points.
  • Spend $1000 in a calendar month: Earn 750 points. (Unavailable in PA) 
    • In FL: “Spend $1000 in a calendar month” bonus available to Tru-Icon members only (750 points)

Benefits of the Program

Participants in the Trulieve Rewards Program enjoy the following benefits:

  • Earn 1 point for every $1 spent.
  • Gain access to point multiplier days, which vary by state.

Tiered Program in Florida

Members in FL qualify for tier status based on their cumulative annual (calendar year) Trulieve Rewards Program spend (i.e. total spend as a Trulieve Rewards Program member). Members qualify for a tier as soon as they cross the spend threshold to enter that tier and maintain that status through the remainder of the calendar year. Annual Trulieve Rewards Program spend resets on January 1st of each year. Members begin the following calendar year in the highest tier they qualified for in the previous calendar year.

State-Specific Program Variations and Compliance

Please be advised that the Trulieve Rewards Program, including the ways in which points can be earned and redeemed, as well as the availability of certain Trulieve Rewards Program benefits, may vary by state due to compliance with state-specific regulations. By participating in the Trulieve Rewards Program, you agree to the terms and conditions applicable within your state of residence.

Dispute Resolution

Any dispute, claim or controversy with respect to, that arises out of, or that relates to, the Trulieve Rewards Program and these Terms and Conditions or any of the arrangements provided for herein whether arising in contract, tort or by statute and including any dispute, claim or controversy concerning the existence, validity, interpretation, enforceability, performance, breach or termination of the Trulieve Rewards Program and these Terms and Conditions, or the validity or enforceability of this Dispute Resolution Section and all claims of arbitrability (each, a “Dispute”) shall be resolved exclusively in accordance with this Dispute Resolution Section.

1. Attempt to Resolve. If any Dispute does arise, you agree to communicate, promptly and in good faith, with Trulieve to discuss and attempt to resolve the Dispute. The terms of any agreement or resolution reached by You and Trulieve in such discussions shall be committed to writing, and such writing shall be treated as confidential and compromise and settlement negotiations for purposes of applicable rules of evidence.

2. Arbitration. If the Dispute is not resolved in the course of such Attempt to Resolve mentioned above, then upon the written demand of You or Trulieve, such Dispute shall be promptly  submitted to and finally resolved by binding arbitration administered by the AAA or its successor in accordance with the American Arbitration Association (“AAA”) or its successor under the commercial arbitration rules and procedures in effect at the time the arbitration commences and the terms of this Dispute Resolution Section. The arbitration shall be conducted before a single neutral arbitrator. The arbitrator shall be selected and appointed in accordance with such AAA rules and procedures. The arbitration shall be conducted in the city of Tallahassee, Florida A and County of Leon. You and Trulieve may be represented by one or more attorneys or other selected representative(s). The arbitrator will give effect to applicable statutes of limitation in determining any Dispute and may dismiss the arbitration on the basis that the Dispute is barred by such statutes of limitation. For purposes of the application of any statutes of limitation, the filing with the AAA under applicable AAA rules and procedures for arbitration of a demand for arbitration is the equivalent of the filing of a lawsuit. Any Dispute concerning this Dispute Resolution Section or whether a Dispute is arbitrable shall   be determined by the arbitrator. The arbitrator may award any appropriate remedy, including monetary damages, injunctive relief or other equitable relief; provided that the arbitrator may not award punitive or exemplary damages. The award shall be in writing and shall be final and binding on the Parties. The award may include interest, as determined by the arbitrator, from the date of any default, breach or other accrual of a Dispute until the arbitral award is paid in full. The arbitration shall be governed by the laws of the State of Florida, including the Florida Uniform Arbitration Act. Any principles of public policy applied by the arbitrators shall consist exclusively of the State of Florida relevant public policy. The Parties submit and consent to the exclusive jurisdiction of the state courts in Florida to compel arbitration, to confirm an arbitration award, or handle other court functions in accordance with the Florida Uniform Arbitration Act. Except to the extent permitted by this Dispute Resolution Section, You and Trulieve expressly waive any right of removal to the United States federal courts, and You and Trulieve expressly waive any right to compel arbitration, to confirm an arbitral award, or seek any aid or assistance of any kind in the United States federal courts. Subject to this Dispute Resolution Section, You and Trulieve will bear and pay equally the fees and expenses of AAA and the arbitrator associated with the arbitration, and each Party will bear its own attorneys’ fees, costs and other expenses in connection with the arbitration.

3. Modification. If the arbitrator determines that the Trulieve Rewards Program and these Terms and Conditions or any part hereof are illegal, invalid, unenforceable, void or voidable, then the arbitrator shall determine and effect an equitable modification of the that complies with applicable law and that approximates as closely as possible the economic arrangements and position of You and Trulieve hereunder. An arbitrator exceeds his or her powers by voiding or refusing to enforce the Trulieve Rewards Program and these Terms and Conditions or any part hereof solely based on the cannabis-related nature of the contract.

4. Jurisdiction. You and Trulieve irrevocably and unconditionally consent to the exclusive jurisdiction of AAA to resolve all Disputes subject to arbitration under the Trulieve Rewards Program and these Terms and Conditions. You and Trulieve further irrevocably waive any objection to proceeding before AAA based upon lack of personal jurisdiction or to the laying of venue and further irrevocably and unconditionally waive and agree not to make a claim in any court that arbitration before AAA has been brought in an inconvenient forum. You and Trulieve hereby consent to service of process by registered mail at the address to which notices are to be given.
